Ocean Ad-Ventures LTD

This Liability Waiver, Assumption of Risk and Release of Claims (“Waiver”) is a legally binding agreement between the undersigned participant (“Participant”) and Ocean Ad-Ventures LTD, its owners, directors, employees, contractors, skippers, instructors, guides, and affiliates (collectively “Ocean Ad-Ventures”).
By booking and/or participating in any trip, cruise, training, rental or activity organized by Ocean Ad-Ventures, the Participant confirms that they have read, understood and agreed to this Waiver.

1. Activities Covered

This Waiver applies to all activities offered or facilitated by Ocean Ad-Ventures, including but not limited to sailing, catamaran cruising, kitesurfing, wingfoiling, windsurfing, SUP, snorkeling, swimming, hiking, equipment rental, transfers and crew assistance. The Participant understands that these activities may take place in remote locations and offshore environments.

Ocean Ad-Ventures makes no guarantees regarding weather conditions, wind, route, specific activities, or availability of planned experiences. Plans may change at any time for safety or operational reasons.

2. Assumption of Risk

The Participant acknowledges that the above activities are inherently dangerous and involve known and unknown risks, including but not limited to:
• Serious injury or death
• Drowning
• Collisions with vessels, boards, foils or other participants
• Equipment failure or loss
• Weather and sea conditions
• Delayed access to medical care
The Participant voluntarily assumes full responsibility for all risks, whether foreseen or unforeseen, except in cases of gross negligence or willful misconduct, where such limitations is not permitted by law.

3. Health & Fitness Declaration

The Participant confirms that:
• They are physically and mentally fit to participate
• They can swim independently in deep water for at least 20 minutes
• They have disclosed all relevant medical conditions prior to the trip
Ocean Ad-Ventures reserves the right to deny or limit participation if safety is compromised.

4. Release of Liability

To the fullest extent permitted by law, the Participant releases and discharges Ocean Ad-Ventures from any and all claims, demands, damages, actions or causes of action arising out of or related to participation in the activities, including but not limited to:
• Personal injury
• Illness
• Property damage or loss
• Equipment damage
• Death
This release applies whether caused by negligence or otherwise.

5. Indemnification

The Participant agrees to indemnify and hold harmless Ocean Ad-Ventures from any claims, liabilities, damages, costs or expenses (including legal fees) arising from:
• Their participation in activities
• Their breach of safety instructions
• Damage to third parties or their property

6. Equipment & Gear Safe+

Equipment: The Participant acknowledges that:
• Use of rented or personal equipment is at their own risk
• All equipment must be handled responsibly and according to instructions, damage needs to be paid before the end of the trip
Gear Safe+ is a voluntary protection product offered by Ocean Ad-Ventures and is not an insurance policy. Gear Safe+ may cover accidental damage to rented equipment during normal use.
Gear Safe+ does NOT cover:
• Gross negligence or reckless behavior
• Loss due to theft or unattended equipment
• Damage caused by riding outside permitted areas or conditions
• Damage caused under the influence of alcohol or drugs
Damage and coverage eligibility will be determined by Ocean Ad-Ventures based on a reasonable assessment at its sole discretion.

7. Minor Participants

Participants under the age of 18 are only permitted on board when accompanied by a parent or legal guardian.
The parent/legal guardian:
• Accepts full responsibility for the minor
• Assumes all risks on behalf of the minor
• Is liable for any damage or costs caused by the minor

8. Safety Rules & Conduct

The Participant agrees to:
• Follow all instructions given by the captain and crew
• Respect safety briefings and operational limits
• Refrain from unsafe, reckless or disruptive behavior
The captain has full authority to restrict or terminate participation without refund if safety is compromised.

9. Travel & Medical Insurance

The Participant acknowledges that Ocean Ad-Ventures strongly recommends adequate travel and medical insurance covering watersports and outdoor activities.
The Participant understands that they participate without mandatory insurance and do so at their own responsibility.

10. Passport & Customs Handling

The Participant agrees that their passport may be temporarily held by the crew for immigration, customs and port clearance purposes. Passports will be returned promptly after completion of formalities.

11. Photography & Media

The Participant grants Ocean Ad-Ventures permission to use photos or videos taken during the trip for marketing and promotional purposes, unless explicitly declined in writing.

12. Severability

If any provision of this Waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13. Acknowledgement & Acceptance

By booking online and/or checking the confirmation box, the Participant confirms that:
• They have read and understood this Waiver
• They agree to all terms and conditions
• This agreement is legally binding
