that:<\/p><p>\u00a0<\/p><ul><li>Participation in sailing, watersports, and outdoor activities involves inherent risks, including serious injury or death<\/li><li>You voluntarily assume all risks associated with these activities<\/li><li>You are physically and mentally fit to participate and able to swim independently for min. 20 minutes<\/li><li>Ocean Ad-Ventures is not liable for injury, loss, damage, or death, except where prohibited by law<\/li><li>Activities, routes, and conditions may change at any time due to weather or safety reasons<\/li><li>You agree to follow all safety instructions from the crew at all times<\/li><li>You are responsible for any damage caused by your actions<\/li><li>Travel and medical insurance is strongly recommended<\/li><li>Your booking constitutes a legally binding agreement<\/li><\/ul><p>\u00a0<\/p><p>By agreeing, you confirm that you have read and agree to the full Liability class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h3>Ocean Ad-Ventures LTD<\/h3><p>\u00a0<\/p><p>This Liability Waiver, Assumption of Risk and Release of Claims (&#8220;Waiver&#8221;) is a legally binding agreement between the undersigned participant (&#8220;Participant&#8221;) and Ocean Ad-Ventures LTD, its owners, directors, employees, contractors, skippers, instructors, guides, and affiliates (collectively &#8220;Ocean Ad-Ventures&#8221;).<br \/>By booking and\/or participating in any trip, cruise, training, rental or activity organized by Ocean Ad-Ventures, the Participant confirms that they have read, understood and agreed to this Waiver.<\/p><h3>\u00a0<\/h3><h3>1. Activities Covered<\/h3><p>This Waiver applies to all activities offered or facilitated by Ocean Ad-Ventures, including but not limited to sailing, catamaran cruising, kitesurfing, wingfoiling, windsurfing, SUP, snorkeling, swimming, hiking, equipment rental, transfers and crew assistance. The Participant understands that these activities may take place in remote locations and offshore environments.<\/p><p>Ocean Ad-Ventures makes no guarantees regarding weather conditions, wind, route, specific activities, or availability of planned experiences. Plans may change at any time for safety or operational reasons.<\/p><h3>\u00a0<\/h3><h3>2. Assumption of Risk<\/h3><p>The Participant acknowledges that the above activities are inherently dangerous and involve known and unknown risks, including but not limited to:<br \/>\u2022 Serious injury or death<br \/>\u2022 Drowning<br \/>\u2022 Collisions with vessels, boards, foils or other participants<br \/>\u2022 Equipment failure or loss<br \/>\u2022 Weather and sea conditions<br \/>\u2022 Delayed access to medical care<br \/>The Participant voluntarily assumes full responsibility for all risks, whether foreseen or unforeseen, except in cases of gross negligence or willful misconduct, where such limitations is not permitted by law.<\/p><h3>\u00a0<\/h3><h3>3. Health &amp; Fitness Declaration<\/h3><p>The Participant confirms that:<br \/>\u2022 They are physically and mentally fit to participate<br \/>\u2022 They can swim independently in deep water for at least 20 minutes<br \/>\u2022 They have disclosed all relevant medical conditions prior to the trip<br \/>Ocean Ad-Ventures reserves the right to deny or limit participation if safety is compromised.<\/p><h3>\u00a0<\/h3><h3>4. Release of Liability<\/h3><p>To the fullest extent permitted by law, the Participant releases and discharges Ocean Ad-Ventures from any and all claims, demands, damages, actions or causes of action arising out of or related to participation in the activities, including but not limited to:<br \/>\u2022 Personal injury<br \/>\u2022 Illness<br \/>\u2022 Property damage or loss<br \/>\u2022 Equipment damage<br \/>\u2022 Death<br \/>This release applies whether caused by negligence or otherwise.<\/p><h3>\u00a0<\/h3><h3>5. Indemnification<\/h3><p>The Participant agrees to indemnify and hold harmless Ocean Ad-Ventures from any claims, liabilities, damages, costs or expenses (including legal fees) arising from:<br \/>\u2022 Their participation in activities<br \/>\u2022 Their breach of safety instructions<br \/>\u2022 Damage to third parties or their property<\/p><h3>\u00a0<\/h3><h3>6. Equipment &amp; Gear Safe+<\/h3><p>Equipment: The Participant acknowledges that:<br \/>\u2022 Use of rented or personal equipment is at their own risk<br \/>\u2022 All equipment must be handled responsibly and according to instructions, damage needs to be paid before the end of the trip<br \/>Gear Safe+ is a voluntary protection product offered by Ocean Ad-Ventures and is not an insurance policy. Gear Safe+ may cover accidental damage to rented equipment during normal use.<br \/>Gear Safe+ does NOT cover:<br \/>\u2022 Gross negligence or reckless behavior<br \/>\u2022 Loss due to theft or unattended equipment<br \/>\u2022 Damage caused by riding outside permitted areas or conditions<br \/>\u2022 Damage caused under the influence of alcohol or drugs<br \/>Damage and coverage eligibility will be determined by Ocean Ad-Ventures based on a reasonable assessment at its sole discretion.<\/p><h3>\u00a0<\/h3><h3>7. Minor Participants<\/h3><p>Participants under the age of 18 are only permitted on board when accompanied by a parent or legal guardian.<br \/>The parent\/legal guardian:<br \/>\u2022 Accepts full responsibility for the minor<br \/>\u2022 Assumes all risks on behalf of the minor<br \/>\u2022 Is liable for any damage or costs caused by the minor<\/p><h3>\u00a0<\/h3><h3>8. Safety Rules &amp; Conduct<\/h3><p>The Participant agrees to:<br \/>\u2022 Follow all instructions given by the captain and crew<br \/>\u2022 Respect safety briefings and operational limits<br \/>\u2022 Refrain from unsafe, reckless or disruptive behavior<br \/>The captain has full authority to restrict or terminate participation without refund if safety is compromised.<\/p><h3>\u00a0<\/h3><h3>9. Travel &amp; Medical Insurance<\/h3><p>The Participant acknowledges that Ocean Ad-Ventures strongly recommends adequate travel and medical insurance covering watersports and outdoor activities.<br \/>The Participant understands that they participate without mandatory insurance and do so at their own responsibility.<\/p><h3>\u00a0<\/h3><h3>10. Passport &amp; Customs Handling<\/h3><p>The Participant agrees that their passport may be temporarily held by the crew for immigration, customs and port clearance purposes. Passports will be returned promptly after completion of formalities.<\/p><h3>\u00a0<\/h3><h3>11. Photography &amp; Media<\/h3><p>The Participant grants Ocean Ad-Ventures permission to use photos or videos taken during the trip for marketing and promotional purposes, unless explicitly declined in writing.<\/p><h3>\u00a0<\/h3><h3>12. Severability<\/h3><p>If any provision of this Waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.<\/p><h3>\u00a0<\/h3><h3>13. Acknowledgement &amp; Acceptance<\/h3><p>By booking online and\/or checking the confirmation box, the Participant confirms that:<br \/>\u2022 They have read and understood this Waiver<br \/>\u2022
