Unternehmen &amp; Leistungsumfang<\/h3><p>Ocean Ad-Ventures LTD (im Folgenden \u201eOcean Ad-Ventures\") organisiert und betreibt Cruises auf Katamaranen in der Karibik und im Rest der Welt, einschlie\u00dflich Segeln, Unterbringung an Bord, Crew-Leistungen und optionalen wassersportbezogenen Aktivit\u00e4ten wie Kiteboarden und Wingfoilen.<\/p><p>Diese Allgemeinen Gesch\u00e4ftsbedingungen gelten f\u00fcr alle Buchungen, egal ob <strong>Kabinen Charter<\/strong> (Buchung einzelner Kabinen) oder <strong>Privat Charter<\/strong> (exklusiver Charter f\u00fcr eine geschlossene Gruppe).<\/p><h3>2. Buchung und Zahlung<\/h3><p>Eine Buchung wird verbindlich, sobald eine <strong>Anzahlung von 30%<\/strong> des Gesamtreisepreises eingegangen ist. Nach Erhalt der Anzahlung best\u00e4tigt und sichert Ocean Ad-Ventures die Buchung.<\/p><p>Der restliche Betrag von <strong>70% ist sp\u00e4testens 45 Tage vor Abreise f\u00e4llig.<\/strong>Wird der Restbetrag nicht rechtzeitig gezahlt, kann dies zur Stornierung der Buchung ohne R\u00fcckerstattung der Anzahlung f\u00fchren.<\/p><p>Zahlungen werden per Bank\u00fcberweisung akzeptiert. Alle Bankgeb\u00fchren tr\u00e4gt der Kunde. <strong>Bei Kreditkartenzahlungen f\u00e4llt ein Bearbeitungsaufschlag von 3% an.<\/strong>.<\/p><p>Ocean Ad-Ventures garantiert, dass best\u00e4tigte Reisen nicht wegen zu weniger Teilnehmer oder notwendiger Yacht-Wartung storniert werden. Sollte der urspr\u00fcnglich gebuchte Katamaran im unwahrscheinlichen Fall nicht verf\u00fcgbar sein, beh\u00e4lt sich Ocean Ad-Ventures das Recht vor, ein gleichwertiges Ersatzschiff zu stellen.<\/p><h3>3. Stornierungs- und R\u00fcckerstattungsbedingungen<\/h3><p>Die folgenden Stornogeb\u00fchren gelten f\u00fcr alle Reisen:<\/p><ul><li>Ab Buchungsbest\u00e4tigung: <strong>10% Bearbeitungsgeb\u00fchr<\/strong> of the total trip price<\/li><li>Up to <strong>Bis 120 Tage<\/strong> vor Abreise: 30% des Gesamtreisepreises <strong>30%<\/strong> of the total trip price<\/li><li><strong>45 Tage oder weniger<\/strong> vor Abreise: <strong>100%<\/strong> of the total trip price<\/li><\/ul><p>Muss Ocean Ad-Ventures eine Reise stornieren und steht keine Alternativreise zur Verf\u00fcgung, werden alle geleisteten Zahlungen vollst\u00e4ndig zur\u00fcckerstattet. Weitere Anspr\u00fcche k\u00f6nnen nicht geltend gemacht werden.<\/p><h3>4. Reisearten<\/h3><p><strong>Kabinen Charter<\/strong><\/p><p>G\u00e4ste buchen einzelne Kabinen und teilen sich den Katamaran mit anderen Teilnehmern.<\/p><p><strong>Privat Charter<\/strong><\/p><p>Der gesamte Katamaran wird exklusiv von einer Gruppe gechartert. Die chartende Partei ist daf\u00fcr verantwortlich, dass alle Teilnehmer diese Allgemeinen Gesch\u00e4ftsbedingungen einhalten.<\/p><p>Sofern nicht ausdr\u00fccklich anders angegeben, gelten f\u00fcr beide Chartertypen dieselben Regeln zu Buchung, Zahlung, Stornierung, Haftung und Sicherheit.<\/p><h3>5. Crew, Verpflegung &amp; Bordleistungen<\/h3><p>Jeder Cruise umfasst einen qualifizierten Kapit\u00e4n und einen Koch. Der Kapit\u00e4n kann auf Wunsch Kite-Unterst\u00fctzung, Segelanleitung und Unterricht bieten. Der Koch bereitet Fr\u00fchst\u00fcck, Mittag- und Abendessen zu und sorgt f\u00fcr die allgemeine Sauberkeit an Bord. Je nach Kursbedarf stellt Ocean Ad-Ventures ein zus\u00e4tzliches Crew-Mitglied f\u00fcr die Organisation des Unterrichts.<\/p><p>Mahlzeiten und Getr\u00e4nke, die an Land konsumiert werden (Restaurants, Strandbars, Caf\u00e9s), sind nicht enthalten. Alkohol wird nicht an Bord gestellt; G\u00e4ste k\u00f6nnen ihren eigenen mitbringen oder kaufen.<\/p><p>Allergien k\u00f6nnen im Voraus mitgeteilt werden. Aufgrund der begrenzten Verf\u00fcgbarkeit von speziellen Produkten in der Karibik k\u00f6nnen individuelle Mahlzeiten oder strenge Spezialdi\u00e4ten nicht garantiert werden.<\/p><h3>6. Fahrlevel &amp; Unterricht<\/h3><p>Sofern nicht vorab anders abgesprochen wird von allen Wassersport G\u00e4sten erwartet, dass sie <strong>eigenst\u00e4ndige Fahrer sind,<\/strong>die Folgendes k\u00f6nnen:<\/p><ul><li>Upwind bleiben<\/li><li>Ihr Board selbst zur\u00fcckholen<\/li><li>Selbstst\u00e4ndig starten und landen<\/li><li>Body-dragging upwind<\/li><\/ul><p>Kommt der Kapit\u00e4n oder Instructor zu der Einsch\u00e4tzung, dass ein Gast diese Anforderungen nicht erf\u00fcllt, <strong>wird Unterricht verpflichtend,<\/strong> bevor eigenst\u00e4ndig weitergefahren werden darf.<\/p><p>Unterricht kann im Voraus oder w\u00e4hrend der Reise organisiert werden, je nach Verf\u00fcgbarkeit. Kursgeb\u00fchren k\u00f6nnen vor Beginn in bar zu zahlen sein.<\/p><h3>7. Materialmiete<\/h3><p>Mietmaterial steht ausschlie\u00dflich eigenst\u00e4ndigen Fahrern zur Verf\u00fcgung und ist von der Verf\u00fcgbarkeit abh\u00e4ngig. Wir stellen Kites, Wings, Boards und Foils zur Verf\u00fcgung. <strong>Trapeze sind nicht enthalten<\/strong>.<\/p><p>Wir empfehlen dringend, Mietmaterial im Voraus zu buchen. W\u00e4hrend der Reise gebuchtes Mietmaterial muss vor Nutzung in bar bezahlt werden.<\/p><p>Der Gast ist f\u00fcr das Mietmaterial verantwortlich. Jeder Schaden oder Verlust muss <strong>muss vor Verlassen des Schiffes beglichen werden,<\/strong>sofern dies nicht durch GearSafe+ abgedeckt ist (siehe Abschnitt 8).<\/p><h3>8. GearSafe+ (Optionaler Materialschutz)<\/h3><p>Gear Safe+ is an <strong>GearSafe+ ist ein optionales Schutzprodukt<\/strong> von Ocean Ad-Ventures.<br \/><strong>Es handelt sich nicht um ein Versicherungsprodukt und wird nicht von einem Versicherer bereitgestellt.<\/strong><\/p><p><strong>Leistungsumfang<\/strong><\/p><p>Bei Erwerb bietet GearSafe+ w\u00e4hrend des Cruise folgende Leistungen:<\/p><ol><li><strong>Sch\u00e4den am Mietmaterial bei normalem Gebrauch<\/strong> during normal use<\/li><li><strong>Vor\u00fcbergehendes Ersatzmaterial, falls das eigene Material des Gastes w\u00e4hrend des Cruise besch\u00e4digt wird<\/strong> if the guest\u2019s own equipment is damaged during the cruise<\/li><li><strong>Ersatz-Mietmaterial, falls pers\u00f6nliches Material bei der Flugreise versp\u00e4tet ankommt oder verloren geht<\/strong> if personal gear is delayed or lost during air travel<\/li><\/ol><p><strong>Ausschl\u00fcsse<\/strong><\/p><p>GearSafe+ deckt nicht ab: <strong>not<\/strong> grobe Fahrl\u00e4ssigkeit oder vors\u00e4tzliche Besch\u00e4digung, Missachtung von Sicherheitsanweisungen oder Crew-Vorgaben, Nutzung unter ungeeigneten oder gef\u00e4hrlichen Bedingungen, Verlust ohne sofortige Meldung, Diebstahl ohne offizielle Polizeianzeige, Sch\u00e4den au\u00dferhalb des Cruise-Zeitraums.<\/p><p>Ocean Ad-Ventures beh\u00e4lt sich das Recht vor zu entscheiden, ob ein Schaden unter die abgedeckten Bedingungen f\u00e4llt.<\/p><h3>9. Versicherungsanforderungen (Reise &amp; Sport)<\/h3><p>We <strong>Wir empfehlen dringend,<\/strong> dass alle G\u00e4ste eine angemessene Reiseversicherung abschlie\u00dfen, die Wassersport und Outdoor-Aktivit\u00e4ten abdeckt, unter anderem: Kitesurfen, Wingfoilen, Segeln, Schnorcheln, Schwimmen, Stand-up Paddling (SUP), Wandern und andere landgest\u00fctzte Aktivit\u00e4ten.<\/p><p>Empfohlen wird eine Abdeckung, die medizinische Behandlung, Notfall-Evakuierung, Unfallversicherung, Gep\u00e4ckversicherung und Reiser\u00fccktrittsversicherung umfasst.<\/p><p>Die G\u00e4ste sind allein daf\u00fcr verantwortlich, die Notwendigkeit und Eignung eines Versicherungsschutzes zu pr\u00fcfen. Ocean Ad-Ventures weist aufgrund der Art der Aktivit\u00e4ten ausdr\u00fccklich auf eine angemessene Absicherung hin.<\/p><h3>10. Gesundheit, Sicherheit &amp; Verhalten<\/h3><p>Mit der Buchung einer Reise best\u00e4tigen die G\u00e4ste, dass sie k\u00f6rperlich und geistig fit zur Teilnahme sind und selbstst\u00e4ndig <strong>mindestens 20 Minuten in tiefem Wasser schwimmen k\u00f6nnen.<\/strong>.<\/p><p>Der Kapit\u00e4n hat die volle Autorit\u00e4t in Bezug auf Sicherheit und Ordnung an Bord. Bei schweren Verletzungen, unsicherem Verhalten oder wiederholter Missachtung von Anweisungen kann der Kapit\u00e4n einen Gast <strong>ohne R\u00fcckerstattung von der weiteren Teilnahme ausschlie\u00dfen.<\/strong>Etwaige daraus entstehende Kosten (Unterkunft, R\u00fcckreise) tr\u00e4gt der Gast.<\/p><h3>11. Minderj\u00e4hrige<\/h3><p>Die Teilnahme von Minderj\u00e4hrigen ist nur in Begleitung eines Elternteils oder gesetzlichen Vormunds an Bord gestattet.<br \/>Eltern oder gesetzliche Vormunde \u00fcbernehmen die volle Verantwortung und Haftung f\u00fcr den Minderj\u00e4hrigen w\u00e4hrend der gesamten Reise.<\/p><h3>12. Reisedokumente &amp; P\u00fcnktlichkeit<\/h3><p>Die G\u00e4ste sind selbst daf\u00fcr verantwortlich, g\u00fcltige P\u00e4sse, Visa und alle weiteren f\u00fcr die Einreise in die besuchten L\u00e4nder erforderlichen Dokumente mitzuf\u00fchren. Reisep\u00e4sse m\u00fcssen mindestens sechs Monate \u00fcber die Reisedaten hinaus g\u00fcltig sein. <strong>six months beyond the travel dates<\/strong>.<\/p><p data-start=\"3885\" data-end=\"4169\">Die G\u00e4ste erkl\u00e4ren sich damit einverstanden, dass ihr Reisepass vor\u00fcbergehend von der Crew eingezogen werden kann, um Einreise-, Zoll- und Hafenformalit\u00e4ten in den jeweiligen L\u00e4ndern abzuwickeln. <strong>passport needs to be temporarily collected by the crew<\/strong> for the purpose of handling immigration, customs, and port clearance procedures in the respective countries.<\/p><p data-start=\"4171\" data-end=\"4275\">Ocean Ad-Ventures \u00fcbernimmt keine Verantwortung f\u00fcr eine verweigerte Einreise aufgrund ung\u00fcltiger oder fehlender Reisedokumente.<\/p><h3 data-start=\"4171\" data-end=\"4275\">13. Haftung &amp; Haftungsverzicht<\/h3><p>Die Teilnahme an Segeln, Kitesurfen, Wingfoilen und verwandten Aktivit\u00e4ten birgt inh\u00e4rente Risiken.
